What Must You Do as a Scottish Landlord?

4. Inform anyone who may disturb ACMs

5. Arrange re-inspection surveys

ACMs must be periodically re-inspected to monitor condition changes. The frequency depends on the material type and risk score.

6. Take action when required

If an ACM deteriorates, is damaged, or work is planned that could disturb it, you must arrange professional management — encapsulation, removal, or other control measures.

Penalties for Non-Compliance

Failure to comply with CAR 2012 Regulation 4 is a criminal offence. Penalties include unlimited fines and up to 2 years imprisonment. The HSE actively enforces these regulations, and local authorities can issue improvement and prohibition notices. Insurance may also be voided if an asbestos incident occurs in a property where the duty to manage has not been met.
